Marriage License Requirements
Requirements for obtaining an Oregon Application, License, and Record of Marriage
- The fee for the Application, License, and Record of Marriage is $50.00. Cash is required at the time the application is issued. (No checks, credit or debit cards)
- There is a three-day waiting period. The Application, License, and Record of Marriage will become valid on the third day after it is issued. Example, if application is issued on Monday, it becomes valid on Thursday. Party A and Party B will take the application with them, but it cannot be used for three days.
- A judge may sign a waiver for just cause to disregard the three-day waiting period. The Linn County Clerk will sign a waiver for military personnel.
- The Application, License, and Record of Marriage will remain in effect for 60 days; it will be valid for use anywhere in the State of Oregon. If not used within that period, Party A and Party B will be required to re-apply and pay.
- Both Party A and Party B must be 18 years of age or older. The Application, License, and Record of Marriage can be issued to persons who are 17 years of age only with a consent form signed by the custodial parent and notarized in the Linn County Clerk’s office.
- The Application, License, and Record of Marriage are not issued to anyone younger than 17, regardless of what the circumstances may be.
- Both Party A and Party B must be present with valid picture ID. A valid driver’s license works great.
- The names of the parents for Party A and Party B are required, their place of birth, the maiden name for the mother of Party A and Party B are also required.
- Party A and Party B must document the legal name each will use after they are married. The information cannot be updated or changed after the Application, License, and Record of Marriage is accepted by the County Clerk for filing, without a court order.
- The Application, License, and Record of Marriage will not be issued to anyone who has a current living wife or husband, or to couples who are first cousins or more closely related.
- No blood test or physicals required.
- The Application, License, and Record of Marriage will be issued from 9:00 A.M. to 4:00 P.M. The office hours are 8:30 A.M. to 5:00 P.M. Monday through Friday; the office is open during the lunch hour.
Party A and Party B must contact judges regarding fees and scheduling a ceremony.
